Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of DEEPWrite, an educational platform operated by Deep Education Network ("we", "us", "our"). DEEPWrite provides adaptive grammar exercises, AI-graded essay writing, and educational tools for UK schools, specifically designed for Key Stage 3 English students (ages 11-14).

By accessing or using DEEPWrite, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our platform.

Effective Date: These Terms are effective as of March 2026 and apply to all users of the platform.

2. Service Description

DEEPWrite is a Software-as-a-Service (SaaS) educational platform providing:

  • Grammar Exercises: Six types of adaptive exercises (drag & drop, rewrite, highlight & identify, fill in the blank, sentence ordering, error correction) aligned with the UK National Curriculum for English
  • Essay Writing Workspace: A dedicated environment for students to write essays with AI-generated feedback
  • AI Grading: Automated assessment of student essays using Claude by Anthropic, with teacher review and override capabilities
  • Progress Tracking: Elo-based mastery scoring (0-100) across 30 curriculum topics
  • Teacher Dashboard: Class management, assignment creation, grading review, and progress reports
  • Reading Annotations: Tools for students to highlight and annotate texts
  • EAL Support: English as Additional Language translation via DeepL

The service is designed for educational use in UK schools and is aligned with Key Stage 3 English learning objectives.

3. Eligibility and Account Registration

3.1 Eligibility

DEEPWrite is available to:

  • Schools: UK educational institutions (primary, secondary, academies, independent schools)
  • Teachers: Educators employed by or authorised by a participating school
  • Students: Pupils aged 11-14 enrolled in a participating school and added to the platform by their teacher

3.2 Teacher Accounts

Teachers must register using a valid school email address and a school access code provided by their school administrator. By registering, teachers confirm that:

  • They are authorised by their school to use DEEPWrite
  • They will comply with their school's data protection policies
  • They will obtain appropriate consent before adding students to the platform
  • They will use the platform solely for educational purposes

3.3 Student Accounts

Student accounts can only be created by teachers. Students cannot self-register. Teachers are responsible for:

  • Ensuring their school has obtained appropriate consent from parents/guardians
  • Providing accurate student information (first name, surname, optional email)
  • Managing student account access and removing accounts when students leave the school

4. Account Responsibilities

Users are responsible for:

  • Security: Maintaining the confidentiality of login credentials and not sharing accounts
  • Accuracy: Providing accurate and up-to-date information
  • Authorised Use: Ensuring all use of the platform is authorised by your school
  • Notification: Immediately notifying us of any unauthorised access or security breaches at privacy@deepeducationnetwork.com

We reserve the right to suspend or terminate accounts that violate these Terms or are used for unauthorised purposes.

5. Acceptable Use Policy

You agree to use DEEPWrite only for lawful educational purposes. The following activities are strictly prohibited:

5.1 Prohibited Activities

  • Plagiarism: Submitting work that is not the student's own original writing (copy-pasting from external sources, using AI tools to write essays)
  • Inappropriate Content: Submitting content that is offensive, discriminatory, violent, sexually explicit, or otherwise inappropriate for an educational setting
  • System Abuse: Attempting to hack, disrupt, or compromise the security of the platform
  • Prompt Injection: Attempting to manipulate AI grading systems through embedded instructions in essays
  • Credential Sharing: Sharing login credentials or allowing unauthorised users to access the platform
  • Data Scraping: Extracting data from the platform using automated tools
  • Commercial Use: Using the platform for non-educational commercial purposes

5.2 Consequences of Violation

Violation of this Acceptable Use Policy may result in account suspension, termination, and referral to school administrators. Serious violations may be reported to appropriate authorities.

6. AI-Generated Content and Grading

6.1 AI Grading Disclaimer

DEEPWrite uses artificial intelligence (Claude by Anthropic) to provide automated feedback and grade suggestions for student essays. You acknowledge and agree that:

  • AI grades are suggestions, not definitive assessments
  • Teachers have final authority over all student grades and can review, modify, or override AI-generated grades at any time
  • AI grading is not a substitute for teacher professional judgement
  • AI-generated feedback should be used as a learning tool, not as the sole basis for assessment

6.2 No Automated Decision-Making

We do not make solely automated decisions that significantly affect students. All AI-generated grades are subject to teacher review. This ensures compliance with Article 22 of UK GDPR, which protects individuals from decisions based solely on automated processing.

6.3 Accuracy and Reliability

While we strive for accuracy, AI systems are not perfect. We do not guarantee that AI-generated feedback will always be correct, appropriate, or aligned with teacher expectations. Teachers should review all AI-generated content before relying on it for educational decisions.

7. Intellectual Property Rights

7.1 Student Work

Students retain ownership of their original written work (essays, exercise responses). By using DEEPWrite, students grant us a limited licence to:

  • Store and display their work within the platform
  • Process their work through AI systems for grading
  • Share their work with their assigned teachers within the platform

We do not claim ownership of student work and will not use it for purposes beyond service delivery without explicit consent.

7.2 Platform Content

DEEPWrite's question bank, exercise templates, essay prompts, curriculum materials, and platform design are proprietary and owned by Deep Education Network. Users may not:

  • Copy, reproduce, or distribute our proprietary content outside the platform
  • Create derivative works based on our content without permission
  • Reverse engineer or attempt to extract our question bank

7.3 Trademarks

"DEEPWrite" and "Deep Education Network" are trademarks of Deep Education Network. You may not use our trademarks without prior written permission.

8. School Subscriptions and Billing

8.1 Subscription Tiers

DEEPWrite offers the following subscription tiers:

  • Free Tier: Limited access for small schools (up to 50 students)
  • Standard Tier: Full access for schools (51-500 students)
  • Premium Tier: Enhanced features including priority support, advanced analytics, and API access (500+ students)

Current pricing is available at write.deepeducationnetwork.com. Prices are subject to change with 30 days' notice.

8.2 Payment Terms

  • Subscriptions are billed annually in advance
  • Payment is processed via Stripe (we do not store payment card details)
  • Invoices are sent to the school's billing email address
  • Late payments may result in service suspension after 30 days

8.3 Cancellation and Refunds

Schools may cancel their subscription at any time by contacting privacy@deepeducationnetwork.com. Upon cancellation:

  • Access continues until the end of the current billing period
  • No refunds are provided for partial billing periods (annual subscriptions are non-refundable)
  • Data export is available for 30 days after cancellation
  • Student data is deleted within 90 days after the end of the billing period (see Privacy Policy)

8.4 Free Trial

New schools may be eligible for a free 30-day trial of the Premium Tier. Trials automatically convert to paid subscriptions unless cancelled before the trial period ends.

9. Data Protection and Privacy

Our collection, use, and protection of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using DEEPWrite, you consent to our data practices as described in the Privacy Policy.

Key points:

  • We comply with UK GDPR, the Data Protection Act 2018, and the ICO's Age Appropriate Design Code
  • Student data is stored in the EU (Germany) for data residency compliance
  • AI processing uses Anthropic (US-based, Standard Contractual Clauses apply)
  • We never sell student data to third parties
  • Students and schools have rights to access, rectify, and delete data

10. Service Availability and Maintenance

10.1 Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. DEEPWrite may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Emergency maintenance or security updates
  • Technical issues beyond our control (network outages, third-party service failures)

10.2 Service Level Commitment

For Premium Tier subscribers, we aim for 99.5% uptime (excluding scheduled maintenance). Free Tier users receive service on a best-efforts basis with no uptime guarantee.

10.3 Planned Maintenance

We schedule maintenance during off-peak hours (weekends, UK evenings) and provide at least 48 hours' notice via email and in-platform notifications.

11. Limitation of Liability

11.1 Educational Tool Disclaimer

DEEPWrite is provided as an educational tool to support learning. We do not guarantee:

  • Specific educational outcomes or exam results
  • That all content is error-free or perfectly aligned with every school's curriculum
  • That AI grading is always accurate or appropriate
  • That the platform will meet all of your school's specific requirements

11.2 Service Provided "As Is"

DEEPWrite is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11.3 Limitation of Damages

To the fullest extent permitted by law, Deep Education Network shall not be liable for:

  • Indirect, incidental, consequential, or punitive damages
  • Loss of data, revenue, or profits
  • Service interruptions or data breaches caused by third parties
  • Decisions made by teachers or schools based on AI-generated feedback

Our total liability for any claim arising from these Terms shall not exceed the amount paid by your school for the DEEPWrite subscription in the 12 months preceding the claim.

11.4 Exceptions

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

12. Indemnification

Schools and teachers agree to indemnify and hold harmless Deep Education Network from any claims, damages, or expenses (including legal fees) arising from:

  • Violation of these Terms
  • Unauthorised use of the platform
  • Breach of data protection obligations
  • Content submitted by students under your supervision
  • Decisions made by teachers based on AI-generated feedback

13. Termination

13.1 Termination by School

Schools may terminate their subscription at any time by contacting us. Access will continue until the end of the current billing period.

13.2 Termination by Deep Education Network

We reserve the right to suspend or terminate accounts that:

  • Violate these Terms or our Acceptable Use Policy
  • Engage in abusive or fraudulent behaviour
  • Fail to pay subscription fees within 30 days of the due date
  • Pose a security risk to the platform or other users

We will provide 14 days' notice before termination (except in cases of serious violations or security threats).

13.3 Effect of Termination

Upon termination, you will lose access to the platform. Data export is available for 30 days after termination. After 90 days, all student data will be permanently deleted in accordance with our Privacy Policy.

14. Modifications to Terms

We may update these Terms from time to time to reflect changes in our service or legal requirements. When we make material changes, we will:

  • Notify schools via email at least 30 days before the changes take effect
  • Display a notice on the platform
  • Update the "Last Updated" date at the top of this page

Continued use of DEEPWrite after the effective date constitutes acceptance of the updated Terms. If you do not agree to the changes, you may terminate your subscription.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of DEEPWrite shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16. Dispute Resolution

Before pursuing legal action, we encourage schools to contact us to resolve disputes informally:

If informal resolution is not possible, disputes may be referred to mediation before court proceedings.

17. Miscellaneous

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Deep Education Network regarding your use of DEEPWrite.

17.2 Assignment

You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations to a successor entity.

17.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

17.4 Force Majeure

We shall not be liable for failure to perform our obligations due to circumstances beyond our reasonable control (natural disasters, war, pandemic, government actions, network failures).
